The probability calculus is very often used in the philosophy of science in order to support or to analyse epistemological points of view. The aim of this paper is to present in a summary the usual axioms of this calculus, as weIl as its most common consequences and theorems, which the philosopher of science in his arguments ressorts to.

In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. Convocada por diferentes estudiosos de los Padres de la Iglesia y del cristianismo antiguo en Latinoamérica, a saber, los profesores Ana Cristina Villa Betancourt, Andrés Mauricio Quevedo Rodríguez y Estiven Valencia Marín, de Colombia; Alejandro Nicola y Francisco Basttita-Harriet, de Argentina; Bruno Gripp, de Brasil; Pamela Chávez Aguilar, de Chile; y Jesús Ma. Aguiñaga Fernández, de México.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

NUTRIÇÃO SOBRE AS FALHAS REPRODUTIVAS DOS BOVINOS -/- E. I. C. da Silva Departamento de Agropecuária – IFPE Campus Belo Jardim Departamento de Zootecnia – UFRPE sede -/- -/- FALHAS REPRODUTIVAS DE BOVINOS -/- INTRODUÇÃO -/- Os bovinos, assim como tantos outros mamíferos e demais espécies, podem sofrer distúrbios durante o ciclo reprodutivo. Transtornos, alterações ou patogenias afetam diretamente a saúde do sistema reprodutor desses animais. As causas podem ser individuais ou multifatoriais, de caráter parasitário, patogênico, climático, nutricional etc. As (...) causas de caráter parasitário podem ser controladas mediante a assepsia e profilaxia para a eliminação dos parasitas como carrapatos que vivem no mesmo habitat que o animal. As de caráter patogênico, como estão relacionadas à doenças, necessitam de especialistas na área, como o médico-veterinário para a avaliação, diagnóstico e tratamento por meio de práticas cirúrgicas ou na administração de fármacos. O fator clima pode ser controlado mediante o investimento em tecnologia e aquisição de equipamentos que possam manter a integridade e o bem-estar do animal, seja por ventiladores, exaustores, nebulizadores, aspersores, etc. Por fim, as de caráter nutricional podem ser prevenidas mediante a boa administração energética, proteica e mineral, além de uma boa qualidade de alimento volumoso ou concentrado que atenda e supra os requerimentos exigidos por cada categoria animal. Sendo assim, pode-se dividir as falhas reprodutivas dos machos bovinos relacionados à nutrição em energia, proteína, minerais e vitaminas. Antes disso, essas falhas estão relacionadas aos fatores de degeneração testicular e casos de hipospermia. -/- 17.1 Degeneração testicular e Hipospermia -/- Degeneração testicular é uma importante causa de infertilidade em machos de todas as espécies. Entre as causas, podem ser consideradas a elevação da temperatura testicular (por isso torna-se importante que a bolsa escrotal tenha um certo tamanho que permita aos testículos ficarem longe do corpo, uma vez que a temperatura corporal mataria os espermatozoides, sendo essencial os testículos ficarem “caídos” para que possam ter no mínimo 2-3 °C à mesmos do que a temperatura corporal), infecções, fatores nutricionais, lesões vasculares, lesões obstrutivas etc. O testículo com degeneração mostra diminuição de tamanho, fibrose, alterações na espermatogênese, aumento de esperma imaturo ou anormal e azoospermia em casos severos. -/- Em casos de lesão testicular com dano parcial sobre o epitélio germinal, apresenta-se uma menor taxa de formação e maturação das células espermáticas. O macho pode ser fértil, mas a condição de hipospermia levará à que, sob condições de estresse ou alta carga de fêmeas a cobrir, se apresentem falhas na fertilização. Ejaculados com características de hipospermia não podem ser congelados, logo não servem para a indústria do sêmen. -/- -/- Deficiências nutricionais retardam o início da puberdade e deprimem a produção e as características do sêmen. Os efeitos da má nutrição podem ser corrigidos em animais maduros, enquanto que é menos bem sucedido em animais jovens devido aos danos permanentes causados no epitélio germinal do testículo. (FRAZER, 2005; GORDON, 1996). Entre as principais limitantes de origem nutricional temos: -/- 17.2 Vitaminas -/- 17.2.1 Vitamina A -/- A deficiência de vitamina A e provitamina A (já que é essencial direta ou indiretamente para a função de todos os órgãos e particularmente para o crescimento e desenvolvimento dos epitélios) é necessária para a diferenciação celular, processo no qual se modificam as células não especializadas de modo que possam realizar funções específicas. Os órgãos reprodutores exigem retinol para que possam realizar o processo de espermatogênese normal nos machos e para prevenir a necrose placentária e a mortalidade fetal na fêmea. Carências de Vitamina A produzem: degeneração do epitélio germinal, baixa espermiogênese parcial ou total, cornificação do epitélio vaginal, irregularidades do estro, atrasos na concepção, abortos, crias fracas e/ou deficientes visuais (cegas) e uma degeneração da placenta e a retenção da mesma. A deficiência da vitamina A pode conduzir a uma degeneração dos tubos seminíferos nos bovinos jovens e deve-se ao fato da supressão da liberação de gonadotropinas hipofisárias e noutros casos, a espermatogênese é impedida e as funções das células de Sertoli e de Leydig são alteradas. A vitamina A não é sintetizada no organismo, o que leva a uma dependência direta do fornecimento dessa vitamina através dos alimentos que o criador têm na propriedade, seja forragens ou concentrados de ótima qualidade. -/- Essa vitamina é essencial para os animais e humanos, visto que participa de inúmeras funções metabólicas no corpo dos mesmos. Sendo assim, o criador deve saber das exigências vitamínicas do seu rebanho. Em bovinos de corte a exigência e a recomendação de fornecimento dessa vitamina está entre 2200 UI/kg de MS para animais em crescimento e engorda e para reprodutores recomenda-se níveis de 3900 UI/kg de MS. Já para bovinos leiteiros esses números são diferentes, de acordo com livros de nutrição de ruminantes, animais em crescimento e engorda devem consumir matéria seca com teores de 80 UI/kg de MS, já para reprodutores e animais adultos a quantidade recomendada e exigida é de 110 UI/kg de MS, isso diariamente. As forragens suprem bem a exigência de vitamina A dos animais, em especial o capim tifton e o tanzânia são os mais recomendados uma vez que possuem altos teores vitamínicos e minerais. As vias de suplementação dessa vitamina é através das forragens (mais acessível e barato), através da ração concentrada ou pela água e suplementação injetável. -/- 17.2.2 Vitamina E -/- A vitamina E é uma substância também conhecida como tocoferol, sendo sua forma mais ativa o alfa tocoferol. A vitamina E pertence ao grupo de vitaminas lipossolúveis amplamente distribuídas nos alimentos. -/- A sua principal função é descrita como um antioxidante natural, agindo como tal, a vitamina E evita a oxidação de constituintes celulares essenciais e/ou evita a formação de produtos tóxicos de oxidação, como os produtos de peroxidação formados a partir de ácidos graxos insaturados que foram detectados através de sua ausência. Essa vitamina é essencial para a reprodução normal em várias espécies de mamíferos. Ela ainda têm sido usada em clínicas reprodutivas de todo o mundo para o tratamento de abortos recorrentes e da infertilidade em ambos os sexos (CHAN, 2003). -/- -/- A deficiência da vitamina E influencia a maturação espermática e a degeneração do epitélio germinal dos túbulos seminíferos, já que ela os protege da oxidação evitando a deterioração da peroxidase sobre os fosfolipídios poli-insaturados da membrana espermática (PITA RODRÍGUEZ, 1997). A deficiência dessa também evita o crescimento anormal. Na ausência de vitamina E, a quantidade de gorduras insaturadas dentro das células diminuem, causando anomalias estruturais e funcionais das organelas mitocondriais, lisossomos e até mesmo na membrana celular, se essa falta de vitamina E no adulto tornar-se acentuada ocorrerá a degeneração precoce do epitélio germinal, o que afeta, em primeiro lugar, as células mais evoluídas: os espermatozoides, cuja mobilidade se perde e sua formação torne-se cada vez mais rara, até chegar ao nível de esterilidade completa. -/- As exigências dos bovinos de corte quanto a vitamina em questão é de 15 – 60 UI/kg de MS diárias para animais em crescimento e engorda. Já para bovinos leiteiros, essa exigência é muito menor chegando a 0,8 UI/kg de peso vivo (PV) para animais em crescimento e engorda e para animais adultos e reprodutores cerca de 1,6 UI/kg de PV diários. Os alimentos, assim como as vias de suplementação ideais, são os mesmos mencionados no tópico acerca da vitamina A. -/- 17.3 Proteínas -/- O efeito do excesso de proteína da dieta na reprodução é complexo. Os excessos de proteína podem também ter um efeito negativo na reprodução. Alguns efeitos foram demonstrados para explicar o pobre desempenho reprodutivo que algumas vezes é observado em dietas com excessivos níveis de proteína: Podem apresentar-se altos níveis de ureia no sangue, o que possui efeito tóxico sobre os espermatozoides, óvulos, e o embrião em desenvolvimento (WATTIAUX, 1990), igualmente, apresenta-se um desequilíbrio energético que em casos severos bloqueia a liberação de LH produzindo alteração na maturação espermática nas células de Leyding. -/- As proteínas são importantes para todo o funcionamento normal e funções fisiológicas e metabólicas dos animais e do homem. Logo, a tabela 1 traz os níveis recomendados e exigências de bovinos de corte de diferentes categorias para que se possa prevenir e/ou combater as possíveis degenerações testiculares bem como a hipospermia, trazendo os requerimentos de bovinos leiteiros jovens o que é mais ideal para combater previamente esses distúrbios que afetam diretamente a função reprodutiva e o desemprenho dos animais. -/- Tabela 1: Exigências de proteína metabolizável (PM) e proteína bruta (PB), para diferentes categorias de bovinos de corte -/- BAIXE O PDF E VISUALIZE A TABELA -/- Para os bovinos leiteiros jovens, os níveis de PB presente na dieta dos animais entre 150 e 400 kg de PV podem ser entre 12 e 22%, o que é ideal para a prevenção de degenerações, atraso à puberdade ou qualquer anormalidade que afete o desempenho dos animais. -/- Os alimentos mais proteicos são os de origem animal, porém não se pode ofertá-los completamente e diretamente aos animais, isto é, deve-se misturá-los a outros ingredientes; logo, o tipo e a quantidade de proteína depende dos ingredientes, do método de alimentação e do potencial produtivo e genético dos animais. -/- 17.4 Minerais -/- 17.4.1 Manganês (Mn) -/- O manganês é um componente de várias enzimas e essencial para a estrutura óssea normal. Quando a alimentação é deficiente em Mn por algumas semanas, o corpo parece conservar este mineral de forma eficaz. -/- Numa dieta média, cerca de 45% do mineral ingerido é absorvido. A absorção pode ser diminuída com o consumo de quantidades excessivas de Ca, P ou Fe. Após a absorção, o Mn liga-se à sua proteína transportadora e é conhecido como transmanganina. Os ossos, e em menor quantidade o fígado, músculos, e pele servem como locais de armazenamento desse mineral. -/- O Mn está envolvido na função pancreática e na utilização correta da glicose, sendo também um interveniente ativo na produção de tiroxina e de hormonas sexuais. Tem importância na produção do colesterol e no metabolismo de gorduras. -/- O Mn é um mineral de grande afinidade com o aparelho reprodutor. A deficiência desse elemento produz uma diminuição da fertilidade, atraso no desenvolvimento testicular e diminuição da espermatogênese. Se houver atrofia dos testículos, a produção de espermatozoides será reduzida e, portanto, a fertilidade será afetada. -/- A quantidade de 13 mg de Mn por kg de MS é suficiente para a obtenção de um crescimento adequado, mas para um crescimento testicular ideal e constante é necessário um mínimo de 16 mg de Mn por kg de MS. -/- Para uma boa suplementação que atenda às necessidades do gado de corte e leite, o nível ideal de Mn presente na MS em mg/kg deve estar entre 12 – 18 para os bovinos leiteiros e entre 20 – 50 para o gado de corte, tendo como recomendação ideal cerca de 40 mg/kg de MS diários para ambos. Esse mineral pode estar presente tanto na água quanto nas plantas presentes no pasto, portanto a suplementação natural é a melhor escolha, caso necessário a suplementação artificial através da ração no cocho ou do sistema SMI é recomendada. -/- 17.4.2 Iodo (I) -/- A deficiência de I também ocasionar dificuldades reprodutivas e hipospermia. Só a captação da tiroide responde à TSH, e somente a glândula endócrina tiroide incorpora esse elemento nos hormônios que são por ela elaborados. Assim, mais de 90% do iodo do organismo é encontrado nas glândulas tireóideas, principalmente como iodo orgânico. Este grande acúmulo de I na glândula é trocado muito lentamente, cerca de 1% por dia. -/- O I entra no organismo via oral e sob a forma de íon iodeto, absorvendo-se muito facilmente desde o aparelho digestivo e passando rapidamente à corrente circulatória e, posteriormente à glândula tiroide (ALBARRACÍN, 2005) onde tem que vencer um gradiente de concentração de 1 a 20; todavia, dada a afinidade entre essa glândula e o iodo, não existe nenhum problema na organização. Na célula folicular, através da ação da peroxidase, converte-se em I molecular que passa para o coloide para se ligar à tiroglobulina e formar as hormonas tireóideas. -/- O I pode atuar sobre o aparelho genital diretamente ou através da hipófise. A tiroidectomia reduz a produção espermática, por sua vez a tiroxina exótica pode restaurá-la. Essa última, administrada dentro de seus limites fisiológicos, aumenta a produção espermática ao incrementar o metabolismo geral. Talvez, o mecanismo mais aceito para atingir esta função fisiológica seja a regulação do consumo de oxigênio pelas células espermáticas. -/- O I pode ser fornecido em quantidades entre 0,2 e 1,0 mg/kg de MS para todas as categorias animais e sem que o produtor possa se preocupar. O I, que é de suma importância, encontra-se na água e nos vegetais, porém pode ser incrementado via alimentação concentrada ou através da injeção mineral direta no animal. -/- 17.5 Energia -/- A disponibilidade de energia está diretamente relacionada com o padrão normal de pulsatilidade do LH. No caso do balanço energético negativo (BEN), verifica-se um rápido aumento da utilização de glicose, resultando em hipoglicemia e, por conseguinte, hipoinsulinemia que, como se sabe, conduz rapidamente a uma lipólise com maior disponibilidade de ácidos para oxidação. Por sua vez, a síntese de colesterol precursor de esteroides sexuais é diminuída. A alteração da relação estrogênios- androgênios no macho causa uma expressão pobre da libido ou desejo sexual. -/- No touro a subnutrição afeta intensamente a função secretora das glândulas acessórias, provocando uma diminuição de 30 a 60% nas concentrações de frutose e ácido láctico do esperma. Perception is said to have assertoric force: It inclines the perceiver to believe its content. In contrast, perceptual imagination is commonly taken to be non-assertoric: Imagining winning a piano contest does not incline the imaginer to believe they actually won. However, abundant evidence from clinical and experimental psychology shows that imagination influences attitudes and behavior in ways similar to perceptual experiences. To account for these phenomena, I propose that perceptual imaginings have implicit assertoric force and put forth a theory—the Prima (...) Facie View—as a unified explanation for the empirical findings reviewed. According to this view, mental images are treated as percepts in operations involving associative memory. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

In this paper I respond to Bird´s objections.

Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. Resemblance Nominalism is the view that denies universals and tropes and claims that what makes F-things F is their resemblances. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. Mellor´s theory of causation has two components, one according to which causes raise their effects´ chances, and one according to which causation links facts. I argue that these two components are not independent from each other and, in particular, that Mellor´s thesis that causation links facts requires his thesis that causes raise their effects´ chances, since without the latter thesis Mellor cannot stop the slingshot argument, an argument that is a threat to any theory postulating facts as the relata of (...) causation. This article will address the considerations that must be examined in the design of public policies and government programs to achieve an intercultural approach to the health of the Pu Mapuce Zomo (Mapuce women). In this sense, the proposed objective is to formulate three essential aspects that serve as a basis to promote adequate frameworks for public health policies oriented towards an intercultural approach. For this, methodologically, from a qualitative approach, the ethical, gender(s) and epistemic aspects that must be considered (...) in the configuration of health programs that favor the health care of indigenous women will be investigated. With this purpose, it begins by delimiting the unavoidable ethical-normative and gender approach to highlight the basic needs of Mapuce women. This approach seeks to establish a parameter about the obligations that States have in relation to the development of human capabilities. Finally, three aspects will be presented that the State must replicate in its health proposals to guarantee the construction of an intercultural approach to health, appropriate to the basic needs of Mapuce women in Argentina. Causation was an important topic of philosophical reflection during the Seventeenth Century. This reflection centred around certain particular problems about causation, one of which was the problem of causation between mind and body. The doctrine of the pre-established harmony is Leibniz's response to the problem of causation between mind and body. In this chapter I shall (a) explain the problem of mind-body causation; (b) explain Leibniz's pre-established harmony; and (c) assess his case for it.

En "Paraconsistencia y fundamentación de las matemáticas" se reformula un aspecto del programa formalista de Hilbert, problema clásico dentro del panorama de la filosofía de las matemáticas. Lo anterior se hace desde un enfoque no clásico de la lógica, particularmente desde LP de Priest. Finalizando el articulo se rescatan las virtudes de la reformulación de este problema clásico y se evalúa hasta qué punto puede ser posible hablar del programa formalista desde la luz de la aritmética inconsistente de Priest.

In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. El objetivo es realizar una revisión sistemática del marco jurídico normativo producido en los distintos programas sanitarios que propician la atención de salud con un enfoque intercultural, centrada concretamente en las mujeres mapuce de Neuquén. Finalmente, nos enfocaremos en la contradicción que se produce cuando, por un lado, se defiende un enfoque sanitario intercultural (...) desde los marcos político-discursivo y jurídico, y, por el otro, se aplica un modelo sanitario biomédico, con tintes patriarcalistas. Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. Do we want an expertocracy, in which an enlightened few design policies for the greater good of the majority and exploit the lack of public knowledge to achieve compliance? (shrink)

Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

Kemp Smith ha demostrado que en esta sección del Tratado Hume estaba respondiendo a los argumentos que Pierre Bayle había utilizado para probar que el razonamiento humano siempre termina refutándose a sí mismo. En este ensayo expongo las falacias en los argumentos de Bayle, las cuales están basadas en una comprensión inadecuada del concepto de extensión. The present study aims at understanding how Ethica Nicomachea V.6 relates to its preceding chapters, V.1-5. On the one hand, the interpreter wonders for what purpose Aristotle introduces a topic named ‘the civic just’ (to politikon dikaion) in V.6, since V.1-5 treats extensively of matters of justice in the city. On the other hand, the same text posits that there is a certain ‘just without qualification’ (to haplōs dikaion), which may or may not be the civic just itself; compared to (...) the just without qualification, other forms of just are so by similitude (kath’homoiteta). In attempting to clear the confusion around those two points, the present study proposes the following: (1) the civic just is the just without qualification insofar as it is the primordial form of the just, in which only humans who are cumulatively free, equals and self-sufficient have a share; (2) the description of the civic just recapitulates several aspects of the discussions of justice in V.1-5 – the laws, the kinds of equality, rule, the legal suit - because the civic just encompasses all the forms of just (dikaion) related to the virtues of universal justice (V.1) and partial justice (V.2-5); (3) the expression to politikon dikaion is introduced in V.6 in order to contrast everything treated in V.1-5 with the domestic just, to oikonomikon dikaion, mentioned for the first time in V.6; (4) the forms of the domestic just are just only by similitude with the civic just because justice loses density outside the civic sphere, a situation which can be explained by the shortcomings Aristotle ascribes to women, children and slaves in EN V.6 (lack either of freedom or equality or yet self-sufficiency) as well as in Politica I (varying degrees of defective deliberation and virtue). The concern of this paper is a version of Resemblance Nominalism according to which resemblance classes, i.e. classes of resembling things, are determined by paradigms. I show that the theory is false, since paradigms do not generally determine resemblance classes. Although I concentrate upon the version of the theory which was delineated by H. H. Price, my results apply to any other theory constructing resemblance classes out of paradigms.

In this paper I discuss a passage from *Naming and Necessity* where Kripke assumes that the essential properties by means of which a definite description designates are a sufficient condition of its rigidity. I put forward two examples that show the falsity of this assumption. Then I examine the non-rigid character of definite descriptions that designate by means of properties that are sufficient conditions of identity of the objects designated by those descriptions. I conclude that the properties by means of (...) which rigid descriptions designate must be both necessary and sufficient conditions of the identity of the designated objects. (shrink)

In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. The paper clarifies the sense of remark 202 of Wittgenstein's *Philosophical Investigations* with respect to its relation to the private language argument. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This paper deals with the mutations in Wittgenstein’s treatment of the notions of “generality” and of “singularity”, from his first philosophy, in the Tractatus Logico-Philosophicus, to his later mature philosophy represented by the Philosophical Investigations. As we shall see, Wittgenstein’s philosophical handling of the notion of “visual perception” plays a key role in those conceptual transformations.
